1. Acceptance of Terms

By accessing or using Inktivo, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms. If you are using Inktivo on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Inktivo is an electronic signature platform that allows users to upload documents, collect signatures from recipients, and manage the signing workflow. The service is provided “as is” and is subject to change at any time.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use Inktivo to:

  • Upload, send, or sign documents that are fraudulent, illegal, or that you do not have authority to execute
  • Impersonate any person or entity or falsely represent your affiliation with any person or entity
  • Attempt to gain unauthorized access to any part of the service or its related systems
  • Transmit malware, spam, or any content that infringes third-party rights
  • Use the service in any way that violates applicable local, national, or international law

5. Electronic Signatures

Electronic signatures created through Inktivo are intended to be legally binding under applicable electronic signature laws, including the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN) and the EU eIDAS Regulation, where applicable. You are solely responsible for ensuring that any document you send complies with the legal requirements of the relevant jurisdiction. Inktivo does not provide legal advice.

6. Data and Privacy

We collect and process personal data as described in our Privacy Policy. By using Inktivo, you consent to such processing. You retain ownership of any documents and data you upload. By uploading content, you grant Inktivo a limited license to store and process that content solely to provide the service.

7. Intellectual Property

Inktivo and all related software, design, and content are our property and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Inktivo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the service. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the three months preceding the claim.

9. Disclaimer of Warranties

Inktivo is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

10. Termination

We reserve the right to suspend or terminate your access to Inktivo at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting support.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the date above. Your continued use of Inktivo after any changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts located in Delaware.
